Legal & Illegal Immigration to USA

USA - Mexican Border

Coming to America by Air, Ship  or Car….you have to pass the US Custom Port of Entry or Borders for Inspections:

BORDERS BETWEEN USA , SOUTH AMERICA, CANADA
Borders between this countries are controlled by Immigration Border Patrols of both countries . They check people coming in and out of  for their documentations, catching & deporting Illegals aliens mostly coming from South America specially from Mexico which is fondly called here as  “WETBACKS”, preventing Terrorist people from middle east to enter the country.

The priority mission of the Border Patrol is preventing terrorists and terrorists weapons, including weapons of mass destruction, from entering the United States.
the CBP mission is vitally important to the protection of America and the American people.

Detention Cell for Illegals before they are deported back to Mexico.  Because Mexico is next door to USA, they can easily come over. They usually jump over the Fence, hide inside the car, trucks; or they just walk into the desert.  Most of them die because of the Heat, long distance, lack of food before they reach USA…..by that time, the surveilance Camera already have spotted them, the patrol agents are usually waiting for them as soon as they appear in the border.

Any questions regarding this topic, let me know.....thanks.. Grin

Re: COMING TO AMERICA ---PORT OF ENTRY & BORDERS-Legal & Illegal Immigration
BS.

US is never going to deport illegal immigrants unless they did something bad. Its not that they're worried about the cost of deporting every single immigrant, but because of the jobs that will be left out when they're out of the country. For example, Mexicans, nobody would mow lawns, plow snows, and build houses. White people are just stupid and they keep complaining that immigrants take over their "jobs". I'm sure none of the white people would do what these Mexicans do for such a low salary. All they want is the money from the government and they're just jealous because lots of immigrants.. whether it be legal or illegal are more successful than them. That's just the way I see it.

Legal Aliens
-----people from other countries  who came here through the legal process…they file papers to live here & were given Visas or permit to live & work. They have the same legal rights & privileges like the Citizens of the country except that they can not VOTE during national elections.

Illegal Aliens --------people without documentations or Visas. By law they have no right to live & work here. They are considered FUGITIVES from the law…..Example: Mexicans crossing borders by foot or car. Also tourist & student with expired Visa who are overstaying in the country are also illegals.  There are lot of  illegal Pilipinos who are hiding and they were called  “ TNT, or tago ng tago…
===================================================

What do you mean BY they CAN NEVER deport all Illegal aliens ?????  You are wrong...…of course Immigration Dept.  can not deport ALL of them because there,s  too many of them to catch & they are all hiding but  they have been deporting illegals for so many years now specially here in California, whether they did nothing wrong or did something wrong, they are deportable for living here without papers and that is the Law.…….they have been doing it quietly as we speak today……………..they do regular  unannounced RAIDS in farming areas, factories, offices, restaurants, hotels….Some special cases are broadcast on news TV , some are not.  Pinakamahigpit mag-deport dito sa California dahil pinaka-maraming aliens dito because this is the Biggest State with the largest population of Immigrants.

USA will survive without the Mexicans because there are also other groups  of people like the Pilipinos, Chinese, Japanese, Vietnamise, Bombay, Samoans, Thais etc…..who are also doing Manual labor jobs.  California has the largest nos. of Pilipino farmers in  the towns of Salinas & Napa…..there are plenty of Vietnamise Carpenters, Japanese works as gardeners mowing lawns, mga Bombay working as Janitors .  My sister hired 4 Chinese laborers to change her house carpets, my cousin has a Japanese gardener, & my other sister hired Vietnamise to Cut the big tree in her backyard and they are all legal aliens.

In the Deep South ( southern States like Georgia, MS, AL etc)  -- specially in remote rural farming areas, there are few foreigners living there, most poor white & black Americans are working in the Farms.  Ex-President Carter in Georgia has a peanut plantation & most of his employees are blacks & white Americans.

Have you not seen the specials on TV shows from Frontline & 60 Minutes about the Mexicans crossing the Borders ?  Those who are caught right there on the border were put in Detention cell. They are photograph, fingerprinted….then on the same night or the next day , they are turn over to the Mexican Border .  The same grp of people will try to return again & again.…..some did it 3,4 or 6 times already….

The information or photos I have posted here are NOT BS……My sources are from the TV specials documentary films,  The Custom Patrol Border Websites,  Reading Books & Newspapers, & my own personal knowledge of real cases from friends, neighbors, co-workers.  My co-worker,s son is an Immigration lawyer & has told me first hand stories of illegals being deported here.  I DON,T WRITE anything that is not true here….I want to get things straight here  regarding this matter.

Re: COMING TO AMERICA ---PORT OF ENTRY & BORDERS-Legal & Illegal Immigration
News Article -  Immigration Raids - catching Illegals Aliens in California

761 Illegals Rounded Up in Southern California Sweep, One of the Largest Ever
Wednesday, January 24, 2007 --- Foxnews.com

SANTA ANA, Calif. — Federal officials said Tuesday they arrested more than 750 illegal immigrants over the past week in the Los Angeles metropolitan area in what they described as one of the biggest such sweeps in U.S. history.
The weeklong series of raids in the five-county region targeted illegal immigrants who had previously been deported for crimes or had ignored final deportation orders.
The raids netted 338 illegal immigrants who were arrested at their homes and apartments and 423 who were identified in area jails since Jan. 17. Those already jailed will be transferred to federal custody when they finish serving their state sentences, said Virginia Kice, spokeswoman for U.S. Immigration and Customs Enforcement.
The sweep netted illegal immigrants from 14 countries in all, including Mexico, Honduras, Ukraine, India, Japan, Poland and Trinidad.

Of the 761 people arrested, more than 450 have already been deported, Kice said.

The raids were a major push within Operation Return to Sender, a crackdown that has resulted in 13,000 arrests nationwide since June. Immigration officials have also identified 3,000 inmates in state and local jails who will be deported. The operation targets those illegal immigrants who go into hiding after skipping their deportation proceedings and criminals who have re-entered the United States after being previously deported for crimes committed in this country.

Officials estimate 600,000 illegal immigrants who have ignored deportation orders are still at large, Kice said.
The Associated Press rode along for the first day of sweeps in Orange County last week. Immigration officers gathered at 4 a.m. in a chilly parking lot for a pep talk, then fanned out to houses in Anaheim and Santa Ana.

At the first stop, an apartment complex, a half-dozen agents arrested a 29-year-old illegal immigrant wanted for a driving-under-the-influence conviction. Kice said that man is now helping them find his brother, a registered s*x offender.
At the second stop, the agents were looking for a convicted rapist and immigration fugitive. Instead, they arrested six men who could not provide legal papers -- and later learned that all six were illegal and four had criminal records.
The rapist they sought had moved out the week before, Kice said.

Re: COMING TO AMERICA ---PORT OF ENTRY & BORDERS-Legal & Illegal Immigration
I'm not saying just Mexicans are the only ones who's going to be deported. I'm talking about every illegal immigrant there is. I can never see US doing that. Like I said in my previous post, they're not worried about the cost of deporting all of them, they are worried who will take over the jobs that they left. Companies can pay illegal immigrants a very low wage. If they leave, white people would never take that job for that same amount of salary. They will always ask for more.

I'm sure other countries will boycott US if they deport these illegals.. and that is going to be bad for our economy.

I have nothing against illegals....the truth is nakaka-awa sila....most of them are ignorant & illiterates....& knew nothing about the law.....their employers are TAKING ADVANTAGE of them by paying them very low wages below the mininum wage because they knew they wont complain  for fear of losing their job & be deported.

Deporting illegals within usa is an internal problem, other countries has no say on this. I dont think it will affect our economy, because the people being deported came from the third world countries that are poor & has poor economy.  Most of this poor countries including Philippines depend on the USA Economic Aid that we give them every year.........unfortunately the Aid the USA gives to this country were pocketed personally by the corrupt sitting President. Kaya sayang lang ang binibigay ng americang aid kasi ninanakaw lang ng mga politicians.

Illegal immigration is one of the biggest problem today in USA.....and they are finding different ways how to solve it.

Life is good in America, it is the superpower of the world & has the largest booming economy ,  that is why everybody wants to come here...and I dont blame them for that.

Permanent Resident Alien  - Green Card Holders ( legal Aliens )
Permanent resident card also called green card ( nickname ) - click to enlarge photo

A Green Card or Permanent Resident Card discloses information that provides an individual,s proof of lawful permanent resident status in the United States. An individual with a Green Card has the right to live and work permanently in the United States. Green Card holders have to follow immigration law and be properly registered with the United States government. Green Card holders are entitled to depart the United States on vacation or for work purposes. However, there are limitations on how long an immigrant can stay outside the United States without losing his or her permanent resident status (Green Card). A document called a "Reentry Permit" must be obtained from the USCIS in many cases.

Green Card Renewal: Individuals with expired Green Cards may be considered "out of status" and may be denied entry into the United States. It is vital to keep your proof of permanent residence current and valid. If your Green Card was issued over 10 years ago, there is an expiration date printed on the front of the card.
Address Change: Permanent residents (Green Card holders) are required by law to inform the USCIS of any address change. It is a misdemeanor to willfully fail to provide the USCIS with a written notice of address change within 10 days.

Responsibilities
You are required to obey all of the laws of the United States, the States, and localities. You are required to file your income tax returns and report your income to the US Internal Revenue Service and State IRS. You are expected to support the democratic form of government and cannot attempt to change the government through illegal means. If you are a male, age 18 through 25, you are required to register with the Selective Service.

International Travel
A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

Rights
To live permanently in the United States provided you do not commit any actions that would make you removable (deportable) under the immigration law (section 237, Immigration and Nationality Act).
To be employed in the United States at any legal work of your qualification and choosing.
To be protected by all of the laws of the United States, your state of residence and local jurisdictions.
To vote in local elections where United States Citizenship is not required.
Exceptions
Some jobs will be limited to United States Citizens because of security concerns.
You may not vote in elections limited to United States Citizens ( Federal level General election Ex: Presidential elections )

You may be found to have abandoned your permanent resident status if you:
Move to another country intending to live there permanently.
Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
Fail to file income tax returns while living outside of the US for any period.
Declare yourself a “nonimmigrant” on your tax returns.

Documents Required when applying for employment

1. Legal papers --- ex. Green card, temporary Visas, citizenship papers
2. Social Security Card
3. DMV licenses or govt.documents with photo Ex: passport

Re: COMING TO AMERICA ---PORT OF ENTRY & BORDERS-Legal & Illegal Immigration
Foreign Workers with Temporary  Work Visas ----can live & work in USA

All foreigners who wish to work in the United States must first obtain a work visa. A work visa is a temporary permit to live and work in the United States. Individuals who work without the appropriate visa are breaking the law and may be deported.
A work visa may be obtained prior to entry into the United States or the applicant may change status after entering the United States on a different visa. Changing status from F-1 Student Visa to H-1B Work Visa is quite common among international college students. H-2B Work Visas are available to workers without higher education, E-3 Work Visas are only for Australian citizens, and H-3 Trainee Visas are available for short-term training at American companies

Student Visa card F-1 ---- temporary visa with expiration date to stay in the country
Student may work but it must be approved by immigration office & School.

H-1B Work Visa General Information: The H-1B Visa enables professionals in "Specialty Occupations" to make a valuable contribution to the American economy. A maximum of 65,000 H-1B Visas are issued every year. The H-1B Visa is issued for up to three years but may be extended. This provides a maximum stay of six years. The H1-B Visa holder can apply for a Green Card if a company wants to sponsor his/her application.

H-1B visa card with expiration date for temporary foreign workers. This card allows you to work & live temporarily ..

H-1B Work Visa Eligibility Requirements: The H-1B Non-Immigrant Work Visa may be issued to applicants seeking temporary work in a "Specialty Occupation" which requires the skills of a professional. "Specialty Occupations" include e.g. accounting, computer analysts, programmers, database administrators, web designers, engineers, financial analysts, doctors, nurses, scientists, architects and lawyers. The petitions are submitted by employers based on their need for the non-U.S.-resident employee. The applicant may possess a bachelor's degree or requisite experience to make up for the lack of a master,s degree.

Green Card through Marriage
Wives and husbands of United States citizens are eligible to apply for a Green Card.
Each year thousands of American citizens marry foreign-born persons and petition for them to obtain permanent residence in the United States. Spouses of U.S. citizens are considered "immediate relatives" under immigration laws. Therefore they are excluded from all numerical quota limitations. This means that there is an unlimited number of Green Cards available to foreign nationals who marry United States citizens.

Family Based Green Cards
Learn how to sponsor your family members and relatives for a Green Card.
Individuals who have close relatives or family members in the United States may apply for permanent residency (green card) if the sponsoring relative is a United States citizen.
The following relatives of U.S. citizens may qualify: Brother; Sister; Son; Daughter; Father; Mother; Stepson; Stepdaughter; Stepfather, Stepmother; Widow; Widower; Adopted Son; Adopted Daughter; Battered or Abused Spouse and Child.

Example of a B-2 Visa: For temporary visitors for pleasure ( tourists ) with expiration date of stay. Tourist are not allowed to work.

B-2 Visa for Tourists: Foreign nationals who wish to visit the United States for leisure or tourism are normally eligible to receive a B-2 Tourist Visas. B-2 Tourist Visas are "visitor visas" required for citizens of countries that are not included in the Visa Waiver Program. However, even citizens of countries included in the Visa Waiver Program are required to obtain a B-2 visa if they plan to stay in the United States for longer than 90 days, change status to other nonimmigrant visa, or adjust status to permanent resident (Green Card) after entering the country.

Re: COMING TO AMERICA ---PORT OF ENTRY & BORDERS-Legal & Illegal Immigration
United States Citizenship ( Naturalized US Citizens )

Naturalization: The process by which a citizen of a foreign country becomes a United States citizen
Eligibility Requirements:
A period of continuous residence and physical presence in the United States
The ability to read, write and speak English
Good moral character
Knowledge of the principles of the U.S. Constitution
Favorable disposition towards the United States
Pass the United States Citizenship Test

About Deportation: Prior to the enactment of IIRAIRA, the legal process of deporting a foreign national was called “deportation” and concerned a foreign national who was already present in the United States. At that time there also existed “exclusion” which concerned a foreign national who was trying to gain admission into the United States. Following the enactment of IIRAIRA, both deportation and exclusion are now referred to as “removal” proceedings. If someone is determined to be removable, they are subject to receiving a removal order and must leave the United States. Any person who is not a U.S. citizen can be deported from the United States.

Visa Holders and Deportation:
The most common reason non-permanent residents (visa holders) are deported/removed is because they entered the U.S. without inspection or without valid entry documents, or because they entered legally on some type of visa, but then overstayed the period of time they were authorized to remain.

Social Security card --- most important US legal document----- without this, employers will not hire you, you can not open bank accts, use for filing taxes, enrolling in schools, for retirement, use for applying medical ins, car ins., credit cards, dmv lic, passports, Immigration purposes...used for other hundreds of things.......it is MANDATORY THAT YOU HAVE THIS CARD. All US citizens and legal immigrants must have this card.

General Information About Social Security:
The Social Security system was set up in the 1930s to provide financial assistance to the disabled and elderly. Employers and employees are required to pay social security taxes to contribute to this fund. Each United States citizen and permanent resident (Green Card holder) has a unique social security number in order to maintain records of the funds being established, as well as to allocate benefits to those who are entitled to receive them.

Some temporary visitors, students and workers on non-immigrant visas are also allowed and sometimes required to obtain a Social Security number. The Social Security card is a very important document in the United States. Not only does it entitle the individual to certain benefits once retired, but employers, banks, schools and the USCIS all use the social security card as a form of identification. Social Security is a complex system that is linked to many other government and private and databases and services.

three types of Social Security cards.

1. The first type of card shows your name and Social Security number and lets you work without restriction. We issue it to:U.S. citizens , People lawfully admitted to the United States on a permanent basis.
2. The second type of card shows your name and number and notes, “VALID FOR WORK ONLY WITH DHS AUTHORIZATION.” We issue this type of card to people lawfully admitted to the United States on a temporary basis to work.
3. The third type of card shows your name and number and notes, “NOT VALID FOR EMPLOYMENT.” We issue it to people from other countries:
Who are lawfully admitted to the United States without work authorization from DHS, but with a valid nonwork reason for needing a Social Security number; or
Who need a number because of a federal law requiring a Social Security number to get a benefit or service.
